Coverage and Exemptions under the Childrens Safety on Motorcycles Act of 2015

The Childrens Safety on Motorcycles Act (Republic Act 10666), enacted in 2015, aims to protect the safety of children while riding on motorcycles. It prohibits any person under the age of 18 from driving a motorcycle.

The law also prohibits children under the age of 12 from riding as passengers on motorcycles, unless they are accompanied by a parent or legal guardian. Children between the ages of 12 and 18 may ride as passengers only if they wear a helmet and are accompanied by an adult.

Exemptions

The Childrens Safety on Motorcycles Act does not apply to children who:

  • Are riding in a sidecar attached to a motorcycle
  • Are participating in a motorcycle safety course
  • Are under the direct supervision of a law enforcement officer
